WESTSIDE BOXING CLUB
PARTICIPANT WAIVER AND RELEASE OF LIABILITY
I, the undersigned participant, agree to the following terms and conditions in consideration of being permitted to participate in any activities conducted by Westside Boxing Club.
1. RULES AND PROPERTY
I agree to abide by all rules, policies, and instructions of Westside Boxing Club and its coaches at all times.
I understand that I am responsible for any damage to equipment or facilities caused by my negligence, excluding fair wear and tear.
2. ACKNOWLEDGEMENT OF RISK
I acknowledge that boxing, strength training, and fitness training are recreational services within the meaning of the Civil Liability Act 2003 (Qld) and involve obvious and inherent risks.
These risks include, but are not limited to:
Physical contact and impact during training or sparring
Lifting weights and resistance training
Dropping weights or equipment failure
Slips, trips and falls
Overexertion, dehydration, or fatigue
Actions of other participants
I understand these risks may result in serious injury, permanent disability, or death.
Activities include (but are not limited to):
Pad work and bag work
Partner drills
Light or full contact sparring
Strength and conditioning training
Weightlifting, resistance training, and functional fitness exercises
Use of barbells, dumbbells, kettlebells, sleds, cardio machines and other gym equipment
Any boxing, gym, or fitness-related activity conducted on or off site
3. WAIVER AND RELEASE
To the fullest extent permitted by law, I hereby:
Waive, release and discharge Westside Boxing Club, its owners, coaches, employees, contractors and affiliates from any and all liability for injury, death, loss or damage arising from my participation in any activities
Agree that this waiver applies to all claims in negligence, contract, tort, equity or otherwise
This waiver does not apply to liability arising from gross negligence, or wilful or reckless misconduct.
4. INDEMNITY
I agree to indemnify and hold harmless Westside Boxing Club from and against any and all:
claims
demands
damages
losses
liabilities
legal costs (on a full indemnity basis)
arising out of or in connection with my participation in any activities or my breach of this agreement.
5. HEALTH DECLARATION
I confirm that:
I am in good physical health and fit to participate in boxing and strength training
I do not suffer from any medical condition that would prevent safe participation
I will inform a coach of any injuries, conditions, or changes to my health
I understand it is my responsibility to seek medical advice if unsure.
6. ASSUMPTION OF RISK
I voluntarily assume full responsibility for all risks of injury, death, or property damage arising from my participation in boxing, gym and fitness activities, whether caused by:
my own actions
the actions of others
or conditions of the premises
7. SAFETY AND CONDUCT
I agree to:
follow all instructions from coaches and staff
use equipment safely and correctly
use appropriate weights for my ability level
immediately stop participation if I feel pain, dizziness, or unsafe
I understand that failure to follow instructions may result in removal from training.
8. EMERGENCY MEDICAL CONSENT
I consent to receiving first aid and emergency medical treatment if required during participation.
I accept responsibility for any costs associated with such treatment.
9. CONTINUING EFFECT
This waiver remains in force for all current and future participation at Westside Boxing Club, including after any temporary or permanent break in training.
10. SEVERABILITY
If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
11. GOVERNING LAW
This agreement is governed by the laws of Queensland, Australia.
12. ENTIRE AGREEMENT
This document constitutes the entire agreement between the parties and supersedes any prior agreements or understandings.
13. ACKNOWLEDGEMENT
I confirm that:
I have read and fully understood this waiver
I understand I am giving up significant legal rights
I sign this agreement voluntarily
